S&W 442 sight trouble

So I got a brand new 442 yesterday for off-duty carry and love it. But there's a small problem; it shoots about 2.5 inches left. Elevation is fine, but, with all different types of ammo, it shoots bad left.

I called customer service and they sent me a label to ship it back to them for inspection. My question is has anyone had this problem before? Am I wasting my,time by sending it back to them? I'd hate to be a month without my pistol just to get it back with a letter saying operator error it shoots fine.
